These Terms and Conditions ("Terms") govern your use of the Tumaoni mobile app and website (the "Service"), operated by Omojadata. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Tumaoni lets a business register its branches and employees, display them on public profiles, and collect feedback (a positive or negative rating and an optional comment) from its customers. Owners can also add their own comments about employees. Some features require a paid subscription.
You must be at least 18 years old and legally able to enter into a contract. By registering a business, you confirm that you are the owner of that business or are authorised to act on its behalf and to accept these Terms for it.
You register and sign in using a one-time code sent to your WhatsApp or mobile number. You are responsible for keeping that number and your device secure and for all activity under your account. You may not impersonate another business or person, or create an account using details you are not authorised to use.
When you add an employee — and, optionally, verify their identity using their National Identification Number (NIDA / NIN) — you represent and warrant that:
The employee's own consent for Ajirame.An employee's record is only made searchable through Tumaoni's employment-history service ("Ajirame") after Tumaoni has obtained that employee's own consent directly (for example, by a confirmation message to the employee), as described in our Privacy Policy. Your informing the employee does not replace that consent, and the employee may withdraw it at any time.
For your day-to-day use of the employee data inside Tumaoni you are the data controller. You agree to indemnify Tumaoni against any claim arising from your failure to obtain the necessary authority, from your misrepresentation of the employment relationship, or from inaccurate or unlawful data you submit.
Feedback must be honest and based on a genuine, recent interaction with the business or employee. Feedback reflects the opinion of the customer, not of Tumaoni. We do not verify feedback and are not responsible for its content. We may remove feedback that we believe is false, defamatory, illegal, harassing, or part of an organised attempt to manipulate a reputation, but we are not obliged to monitor or remove content.
You acknowledge that feedback and the related snapshots of the business, branch, and employee are retained for the employment-history purpose and are not automatically deleted when you delete an employee, branch, business, or your account, so that the record stays accurate over time. For employees who have given their own consent, this history may be used in Tumaoni's employment-history service and may be searchable, including by an employee's NIDA number.
This retention is not unlimited or irreversible. As explained in our Privacy Policy, an employee may withdraw consent or request erasure at any time, and we will then de-identify their record — removing the NIDA number, name, and photograph — so it is no longer searchable or attributable to them. This applies to comments you write about an employee as well: they are retained as part of the record, but are subject to the employee's erasure rights.
You agree that you will not:
The Tumaoni name, app, website, and software are owned by Omojadata. You keep ownership of the content you submit (such as your business details and logo) but grant Tumaoni a licence to host, display, and process that content as needed to operate the Service, including the records-retention and employment-history purposes described above.
You may delete your account at any time from within the app. We may suspend or terminate accounts that breach these Terms or the law. Termination does not by itself delete feedback records retained for the employment-history service, as described in section 6 and our Privacy Policy; those records remain subject to the relevant employee's erasure and consent-withdrawal rights.
The Service is provided "as is" and "as available." We do our best to keep it available, secure, and accurate, but we make no warranties of any kind, express or implied, including as to the accuracy of feedback, NIDA-derived data, or uninterrupted availability.
To the maximum extent permitted by law, Tumaoni and Omojadata will not be liable for any indirect, incidental, or consequential loss, or for loss of profit, reputation, or data, arising from your use of the Service or from feedback or content submitted by others. Nothing in these Terms limits liability that cannot be limited under Tanzanian law.
You agree to indemnify and hold Tumaoni and Omojadata harmless from any claim, loss, or expense arising from your breach of these Terms, your misuse of the Service, or your handling of employee or customer data.
These Terms are governed by the laws of the United Republic of Tanzania, and any dispute is subject to the jurisdiction of the courts of Tanzania.
We may update these Terms. The "Last updated" date reflects the most recent change. Continued use of the Service after a change means you accept the updated Terms.
